Terms of Service

The short version. Concierge is desktop software licensed to you, not sold. Try it free for 14 days; after that a subscription keeps the Pro features unlocked. It runs on your computer, so looking after your own data and backups is your responsibility.

Concierge assists with screening — it does not make hiring decisions. You are responsible for the decisions you make and for complying with employment and anti-discrimination law.

1. Who these terms are with

These terms are an agreement between you (or the organisation you represent) and SyphonDigital, a sole trader registered in Australia, covering your use of the Concierge desktop application and this website. By installing or using Concierge you accept these terms. If you do not accept them, do not use the software.

2. Licence

Subject to these terms, we grant you a non-exclusive, non-transferable, revocable licence to install and use Concierge for your own business or personal hiring purposes.

The software is licensed, not sold. We retain all intellectual property rights in Concierge. You retain all rights in your own data.

3. Trial and subscription

Payments are processed by Lemon Squeezy as merchant of record. Their terms govern the transaction itself, including tax handling.

4. Refunds

Because a full-featured 14-day trial is available before any payment, we ask that you use it to confirm the software suits you. If something is wrong — it does not work as described, or you were charged in error — contact support@syphondigital.online within 30 days of the charge and we will work with you in good faith, including issuing a refund where appropriate.

Nothing here limits rights you have under the Australian Consumer Law or equivalent consumer protection law in your country. Those rights apply regardless of anything in these terms.

5. Your responsibilities

Your data and your device

Concierge stores your data on your computer. You are responsible for that device, for its security, and for keeping your own backups. The app makes automatic local snapshots, but those live on the same machine — they will not survive a lost, stolen or failed computer. Keep independent backups of anything you cannot afford to lose.

Candidate information and the law

You are responsible for handling candidate information lawfully — including obtaining any consent required, honouring access and deletion requests, and complying with the Privacy Act 1988 (Cth), anti-discrimination law, and any equivalent laws applying to you or your candidates. Third-party AI services

If you connect your own AI provider key, that use is governed by your agreement with that provider, at your cost, and résumé text you analyse is transmitted to them. Concierge works fully offline if you would prefer that not to happen.

6. Assistance, not decision-making

This matters, so it is stated plainly. Concierge produces scores, rankings, insights and suggested shortlists to help you review applications faster. Those outputs are generated from automated analysis and, where you enable it, from AI models. They:

You remain the decision-maker. You are responsible for reviewing candidates yourself and for ensuring your hiring process is fair, lawful and non-discriminatory. We are not liable for hiring decisions you make.

7. Availability and changes

We may update Concierge to fix problems, improve it, or add features. We may change or discontinue features, and we may revise these terms — the date at the top of this page will change, and continuing to use the software means you accept the revision. If we discontinue the product entirely, we will give reasonable notice, and your data remains on your device and exportable.

8. Warranty

Except for guarantees that cannot be excluded by law, Concierge is provided "as is", without warranties of any kind, express or implied, including fitness for a particular purpose or uninterrupted operation.

If you are a consumer under the Australian Consumer Law, our goods and services come with guarantees that cannot be excluded. Where we are permitted to limit our liability for a breach of those guarantees, our liability is limited to resupplying the software or paying the cost of resupply.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, or for loss of profits, revenue, data, or business opportunity, arising from your use of Concierge — including data loss, hiring outcomes, or the acts of any third-party service you connect.

Where liability cannot be excluded, our total liability is limited to the amount you paid us for the software in the 12 months before the claim.

10. Termination

You may stop using Concierge at any time and uninstall it. We may suspend or terminate your licence if you materially breach these terms, including by circumventing licensing. On termination the licence ends, but your data remains yours and stays on your device.

11. Governing law

These terms are governed by the laws of Australia, and the courts of Australia have jurisdiction. If any provision is found unenforceable, the rest continues to apply.
